By using the services of Tweetajob, Inc. ("Tweetajob") and the Tweetajob website (together, the “Services”) you are agreeing to be bound by these Terms of Service (the "Terms of Service"). If you do not agree to these Terms of Service in their entirety or if you do not fully comply with these Terms of Service, you may not use the Services. By using the Services, you agree that these Terms of Service constitute a binding agreement between you and Tweetajob.
Tweetajob reserves the right to update and change these Terms of Service from time to time without notice. Any new features that enhance the current Services, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of any of the Services after any such changes to the Terms of Service shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at www.tweetajob.com.
Violation of any of the Terms of Service will result in the termination of your account with Tweetajob (your “Account”). You agree to use the Services at your own risk.
License to use the Services
- If you are using the Services as a jobseeker, Tweetajob hereby grants you a limited, terminable, non-exclusive right to access and use the Services only for your personal use seeking employment opportunities for yourself. This authorizes you view and use the Services solely for your personal, noncommercial use.
- If you are using the Services as an employer or recruiter, Tweetajob hereby grants you a limited, terminable, non-exclusive right to access and use the Services only for your internal business use seeking candidates for employment. This authorizes you to view and use the Services solely for your personal use directly related to using the Services for the purpose of posting jobs and searching and recruiting job prospects.
- All users of the Services (each a “User” and together, the “Users”) represent, warrant and agree that they will not use (or plan, encourage or help others to use) the Services for any purpose or in any manner that is prohibited by these Terms of Use or by applicable law. It is each User’s responsibility to ensure that their use of the Services complies with these Terms of Use.
Account Terms
- You must be 13 years or older to use the Services.
- You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
- Your login may only be used by one person — a single login shared by multiple people is not permitted. You may create separate logins for as many people as you'd like.
- You must be a human. Accounts registered by "bots" or automated methods are not permitted.
- You are responsible for maintaining the security of your account and password. Tweetajob cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- You are responsible for all content (including but not limited to resume’s, job postings and descriptions, etc.) posted and activity that occurs under your account (“Content”), even when Content is posted by others who have accounts under your account.
- One person or legal entity may not maintain more than one free account.
- You may not use the Services for any illegal or unauthorized purpose. You may not, in the use of the Services, violate any laws in your jurisdiction (including but not limited to copyright laws).
Rules for Posting Content
- Your Content may not contain: (i) copyrighted material (unless you own the copyright or have the owner's permission to post the copyrighted material); (ii) trade secrets (unless you own them or have the owner's permission to post them); (iii) material that infringes on or misappropriates any other intellectual property rights, or violates the privacy or publicity rights of others; (iv) anything that is sexually explicit, obscene, libelous, defamatory, threatening, harassing, abusive, or hateful; or (v) anything that is embarrassing or offensive to another person or entity.
- You may not use your Content to: (i) impersonate another person, living or dead; (ii) post false, inaccurate or misleading information; (iii) post advertisements or solicitations of business (including, but not limited to, Multi-Level Marketing [MLM] positions, Email Processors, franchises, ‘club memberships,’ distributorships, or anything requiring a monetary investment by the User); (iv) post chain letters or pyramid schemes; or (v) post opinions or notices, commercial or otherwise.
- Job postings must contain sufficient detail to convey clearly to the User the nature and requirements of the job opportunity, or your qualifications as a candidate for employment. Content that encourages the User to ‘email for more details’ are not permitted. Content from any third party charging a fee or restricting complete access to all resume information is prohibited.
- Resume postings must contain the accurate resume of a living individual seeking employment on a full-time, part-time, or contractual basis on his or her own behalf.
- Tweetajob is under no obligation to monitor the Content posted on the Services, but it may monitor Content at random. Content found to violate these Terms of Service may be removed at Tweetajob’s discretion.
While Tweetajob prohibits the above conduct on the Services, you understand and agree that Tweetajob cannot be responsible for the all information posted on the Services and you nonetheless may be exposed to such materials.
Modifications to the Services and Prices
- Tweetajob reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice.
- Prices of all Services, including but not limited to monthly subscription plan fees and fees charged on a per-Tweet basis, are subject to change upon 30 days notice from Tweetajob. Such notice may be provided at any time by posting on the on www.tweetajob.com or the Services.
- Tweetajob shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Services.
- Tweetajob may revise these Terms of Service at any time by updating this page. Changes will be binding on you on the date they are posted (or as otherwise stated in the any notice of such changes). Any use of the Services will be considered acceptance by you of the then-current Terms of Services. If at any time you find the Terms of Services unacceptable, you may not use the Services any longer. Any new or different terms supplied by you are specifically rejected by Tweetajob unless Tweetajob agrees to them in a signed writing specifically including those new or different terms.
Cancellation and Termination
- If you are using the Services as a jobseeker, Tweetajob reserves the right to cancel or terminate your Account at any time, for any reason or no reason.
- If you are using the Services as an employer or recruiter, Tweetajob reserves the right to cancel or terminate your Account upon the breach of these Terms of Service or for nonpayment.
- You may cancel your Account at any time. You are solely responsible for properly canceling your account. You must send an email to info@tweetajob.com requesting cancellation of your account.
- Upon cancellation or termination of your Account for any reason, all of your Content will be immediately deleted from the Services. This information can not be recovered once your Account is cancelled.
- Tweetajob does not accept any liability for loss of Content due to Account cancellation.
- If you cancel the Services before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again.
- If your Account is terminated per these Terms of Services, you will not be entitled to a refund from Tweetajob.
Copyright and Content Ownership
- Tweetajob claims no intellectual property rights over your Content. Your profile and materials uploaded remain yours. However, you agree to allow others to view and share your Content upon signing up for the Services, and you grant Tweetajob a perpetual, non-exclusive license to use your Content to provide the Services and make your Content (including your resume or job description or posting) publicly available.
- Tweetajob does not pre-screen Content, but Tweetajob reserves the right (but not the obligation) in in Tweetajob’s sole discretion to refuse or remove any Content that is available via the Services.
- The Services and all right, title and interest in and to the Services are the sole property of Tweetajob and/or its licensors, and is protected by U.S. copyright and international treaties. Except for the limited licenses expressly granted to you in these Terms of Service, Tweetajob reserves for itself and its licensors all other right, title, and interest.
- Without limitation on the foregoing, you may not reproduce, modify, display, sell, or distribute any text, graphics, design, or programming used in the Services (the “Tweetajob Content”), or use any of the Tweetajob Content in any other way for public or commercial purpose, other than “retweeting” or rebroadcasting Tweetajob’s “tweets”. In addition, the ‘look’ and ‘feel’ of the Services (including color combinations, button shapes, layout, design and all other graphical elements on all pages of www.tweetajob.com) are also protected by Tweetajob’s trademarks, service marks, and copyrights. All other product and service marks contained on the Services are the trademarks of their respective owners.
- Tweetajob undertakes to obey all relevant copyright laws. Tweetajob will review all claims of copyright infringement received and remove Content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
- A physical or electronic signature of the copyright owner or the person authorized to act on its behalf
- A description of the copyrighted work claimed to have been infringed
- A description of the infringing material and information reasonably sufficient to permit Tweetajob to locate the material
- Your contact information, including your address, telephone number, and email
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law, and
- A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
General Conditions
- Your use of the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis.
- Technical support is only provided to paying account holders and is only available via email.
- You understand that Tweetajob uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services.
- You may not modify, adapt or hack the Services or modify another website so as to falsely imply that it is associated with the Services, Tweetajob, or any other Tweetajob service.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission by Tweetajob.
- Tweetajob may, but has no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or any Content which violates any party's intellectual property or these Terms of Service.
- Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Tweetajob customer, employee, member, or officer will result in immediate account termination.
- You understand that the technical processing and transmission of the Services, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
- You may not upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.
- You may not transmit any worms or viruses or any code of a destructive nature.
- If your bandwidth usage exceeds 300 MB/month, or significantly exceeds the average bandwidth usage (as determined solely by Tweetajob) of other Tweetajob customers, we reserve the right to immediately disable or impose restrictions upon your Account until you can reduce your bandwidth consumption.
- Tweetajob does not warrant that (i) the Services will meet your specific requirements, (ii) the Services will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Services will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Services will meet your expectations, and (v) any errors in the Services will be corrected.
- You expressly understand and agree that Tweetajob shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Tweetajob has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Services; (v) or any other matter relating to the Services.
- The failure of Tweetajob to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Tweetajob regarding your use of the Services. The Terms of Service govern your use of the Services and supersede any prior agreements between you and Tweetajob (including, but not limited to, any prior versions of the Terms of Service).
Disclaimers
- Tweetajob assumes no responsibility for Content posted by Users and no responsibility for the activities, omissions or other conduct of Users.
- Nothing on the Services or on www.tweetajob.com shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regards to its Web site, products, services, hiring, experience, employment or recruiting practices, or otherwise.
- Tweetajob is not an employment agency or a recruiting firm, and makes no representations or guarantees regarding the effectiveness or timeliness of the Services in meeting the employment objectives of Users. Tweetajob does not guarantee that Content posted by Users will result in candidates being hired or positions being filled, and is not responsible for any employment decisions, for whatever reason made, made by any User. Tweetajob does not guarantee or warrant the accuracy of any information posted in any job description, resume, or in any Content.
- HE SERVICES PROVIDED ON AN 'AS IS' BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TWEETAJOB, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. TWEETAJOB MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SERVICES, THE CONTENT, OR THE TWEETAJOB CONTENT.
- Without limiting the foregoing, TWEETAJOB DOES NOT WARRANT THAT THE SERVICES WILL OPERATE ERROR-FREE OR THAT THE SERVICES AND THEIR SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE SERVICES RESULTS DIRECTLY OR INDIRECTLY IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, TWEETAJOB IS NOT RESPONSIBLE FOR THOSE COSTS.
- Tweetajob makes no representations or guarantees regarding the truthfulness, accuracy, completeness, timeliness or reliability of any Content posted by Users, or of any other form of communication engaged in by Users. Content may contain inaccuracies or typographical errors. You agree that any reliance on Content posted by Users, or on any other form of communication with Users, will be at your own risk.
- Tweetajob makes no representations or guarantees regarding the Content, the Tweetajob Content, or the Services, including, but not limited to, broken links, inaccuracies or typographical errors.
Damage Limitations, Allocations of Liability, and Equitable Relief
- YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICES, THE INTERNET GENERALLY, AND THE CONTENT YOU POST OR ACCESS AND FOR YOUR CONDUCT ON AND OFF THE SERVICES.
- IN NO EVENT SHALL TWEETAJOB (OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY NON-DIRECT DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION) RESULTING FROM OR ARISING UNDER OR IN CONNECTION WITH THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THE SERVICES AND/OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TWEETAJOB IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OR LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE LIMITATIONS SET FORTH IN THE PRECEDING PARAGRAPH MAY NOT APPLY TO YOU. IF ANY ARE HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THEN TWEETAJOB’S MAXIMUM LIABILITY TO YOU FOR ANY NON-DIRECT TYPE OF DAMAGES SHALL BE LIMITED TO U.S. $250.00 IN THE AGGREGATE.
- IN NO EVENT SHALL TWEETAJOB (OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY DIRECT DAMAGES IN EXCESS IN THE AGGREGATE OF US$250.00 (OR, IF YOU ARE AN EMPLOYER OR RECRUITER PAYING TO USE THE SERVICES, THE AMOUNTS ACTUALLY PAID BY YOU TO TWEETAJOB IF GREATER THAN US$250.00).
- Due to the nature of these Terms of Service, in addition to money damages, Tweetajob will be entitled to equitable relief upon a breach of these Terms of Service by you.
Indemnity
You agree to defend, indemnify, and hold harmless Tweetajob (and its officers, directors, employees and agents) from and against any claims, actions or demands (including, without limitation, costs, damages and reasonable legal and accounting fees) alleging or resulting from or in connection with your use of the Services, any Content posted by you, or your breach of these Terms of Service. Tweetajob shall use reasonable efforts to provide you prompt notice of any such claim, suit, or proceeding and may assist you, at your expense, in defending any such claim, suit or proceeding.
User Information
Tweetajob’s Privacy Policy (the “Privacy Policy”) is posted on the www.tweetajob.com and is incorporated into these Terms of Service by this reference. The Privacy Policy governs data collected through Tweetajob’s on-line operations only. In addition, Tweetajob reserves the right to comply, in its sole discretion, with legal requirements.
General
Tweetajob’s contact information is listed on www.tweetajob.com. Tweetajob makes no claims that the Tweetajob Content or the Services are appropriate or may be downloaded outside of the United States. Access to the Tweetajob Content and/or the Services may not be legal by certain persons or in certain countries, and such persons have no right to access or use the Services. If you access Tweetajob from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms of Service are governed by the internal substantive laws of the State of Washington, without respect to its conflict of laws principles. Jurisdiction for any claims arising under these Terms of Services shall lie exclusively with the state or federal courts in the State of Washington. The relationship between you and Treetajob is that of independent contractors. If any provision of these Terms of Services are found to be invalid by any court having competent jurisdiction, the invalidity of all or part of a provision shall not affect the validity of the remaining parts and provisions of these Terms of Service, which shall remain in full force and effect. All provisions of these Terms of Service shall survive termination except those granting access or use to the Services, and you shall cease all your use and access thereof immediately. You may not assign or transfer your obligations under these Terms of Service. No waiver of any term of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term.
